We assisted in securing an appeal under section 78 of the Town and Country Planning Act 1990, against a refusal by Ashford Borough Council to grant outline planning permission for the erection of up to 100 dwellings, parking, landscaping open space and associated works at Land South of Tilden Gill Road, Tenterden in Kent.

Outline planning permission for up to 100 dwellings with the details of access, scale, appearance, layout and landscaping was granted at Appeal in April 2018. A key issue for the reserved matters submission was for the design to respect the AONB fringe, providing generous gardens to all houses and to include 1.66 ha of land set aside for ecological purposes.

The reserved matters submission was deferred twice by Committee, despite an officers’ recommendations for approval. An appeal for non-determination was lodged in July 2019 and a second application submitted in February 2019. The second submission was favourably determined in July 2019.

Construction has commenced, current instructions include condition discharge submissions a fresh s73 to the outline is under consideration and we also chaired the Local Community Construction Forum group.
